Waterfowl Management Academy – Terms & Conditions

By accessing or using the Waterfowl Management Academy ("WMA") website, services, content, or membership program, you agree to the following Terms and Conditions. If you do not agree, please do not access our site or become a member.

1. Educational Content Only

All content provided by WMA including videos, written guides, Q&A sessions, and direct communication with our team ("WMA Content") is protected by copyright and other intellectual property rights and is owned by or licensed to WMA. WMA Content is provided for general educational purposes only and may not be copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited without WMA's prior written consent. It is not professional, legal, ecological, engineering, or regulatory advice.

Outcomes may vary based on site-specific conditions, local regulations, and uncontrollable environmental factors.

2. No Guarantees or Warranties

We make no guarantees regarding the results of implementing any management practices, recommendations, or strategies presented in our materials or communications.
All content is provided “as is” without warranties of any kind, neither express nor implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

3. User Assumes Responsibility

By accessing WMA’s content or applying any management techniques, you assume full responsibility for your land, wetland, or wildlife outcomes. You acknowledge that land management involves inherent risks and site variability.

4. Indemnification

You agree to indemnify, defend, and hold harmless Waterfowl Management Academy, its owners, employees, advisors, and contributors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of our content, services, or advice.

This includes but is not limited to any legal claims from third parties related to property damage, regulatory violations, or negative habitat outcomes.

5. Government Programs, Easements, and Land Use Restrictions

Waterfowl Management Academy (“WMA”) does not have access to information about your property’s enrollment in any federal, state, or local conservation programs, easements, or cost-share agreements.

These may include, but are not limited to:

  • Conservation Reserve Program (CRP)

  • Wetlands Reserve Program (WRP)

  • Agricultural Conservation Easement Program (ACEP)

  • Environmental Quality Incentives Program (EQIP)

  • Conservation Stewardship Program (CSP)

  • Partners for Fish and Wildlife Program (PFW)

  • State and local cost-share agreements

  • Private easements such as Ducks Unlimited (DU) conservation easements

Many of these programs carry strict legal restrictions on activities such as:

  • Water level manipulation

  • Vegetation removal or disturbance

  • Soil disturbance (disking, plowing)

  • Tree removal

  • Installation or alteration of levees, dikes, ditches, or water control structures

  • Grazing or haying

  • Hunting or recreational use

WMA’s educational content and recommendations are general in nature and may not be compliant with your specific program rules.

By using WMA’s services, you agree that:

  • You are solely responsible for determining if your property is subject to any such restrictions

  • You will consult with your program administrator or conservation partner before implementing any practices based on WMA’s materials

  • You will not hold WMA or its contributors liable for any penalties, violations, or funding losses that may result from use of our content

6. Limitation of Liability

WMA, including its founders, team members, guest experts, and contributors (including but not limited to Dan Crigler and Michael Flaspohler) shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

  • The use, misuse, interpretation, or application of our content, services, educational materials, advice, recommendations, or guidance, whether provided in written, verbal, or any other form

  • Any action taken, not taken, delayed, or modified based on our educational material, including but not limited to financial decisions, business strategies, investment choices, career decisions, or any other personal or professional actions. Users acknowledge that all decisions are made at their own risk and discretion, regardless of any information or guidance provided by WMA

  • Communications between users and WMA team members

You understand and agree that you are solely responsible for how you use our information.

7. User Conduct

You agree not to:

  • Misrepresent WMA’s content as your own

  • Share, reproduce, or distribute WMA member content without written permission

  • Violate any local, state, or federal laws in the application of techniques learned through WMA

8. Revisions and Updates

We reserve the right to revise these Terms & Conditions at any time. Updates will be posted on this page with a revised effective date. Continued use of WMA’s services constitutes your acceptance of any changes. If you do not agree to the modified terms, you must discontinue using our services.

10. Refund Policy All purchases are final. However, WMA may, at its sole discretion, offer refunds on a case-by-case basis within 30 days of purchase if a member is dissatisfied with our services. No refunds will be provided for any claims related to implementation outcomes or results achieved using our educational content.

11. Governing Law and Jurisdiction These Terms & Conditions shall be governed by and construed in accordance with the laws of Missouri, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Missouri.
